1. OVERVIEW
PacksMC respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our platform. This policy outlines the process for reporting copyright violations and how we handle such reports.
2. REPORTING COPYRIGHT INFRINGEMENT
If you believe that content hosted on PacksMC infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent. Your notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including the URL or other specific location on PacksMC where the material can be found
- Your contact information, including your name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner
3. WHERE TO SEND NOTICES
DMCA takedown notices should be sent to our designated copyright agent:
PacksMC Copyright Agent
Email: dmca@packsmc.com
You may also use the Report button on any pack page to flag potentially infringing content directly through the platform.
4. HOW WE HANDLE TAKEDOWN REQUESTS
Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing material
- Notify the user who posted the content that it has been removed
- Provide the user with a copy of the takedown notice (with personal information of the reporter redacted where appropriate)
- Process the claim typically within 24 hours of receipt
5. COUNTER-NOTIFICATION
If you believe that your content was removed in error or that you have authorization to use the material, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court in your judicial district
If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.
6. REPEAT INFRINGERS
PacksMC maintains a policy of terminating the accounts of users who are repeat copyright infringers. Users who receive multiple valid DMCA takedown notices may have their accounts suspended or permanently banned at our discretion.
7. GOOD FAITH
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Please ensure that you have a genuine claim before submitting a takedown notice.
